General information

The following information provides a simple overview of what happens to your personal data when you visit this website. Personal data is any data that can be used to identify you personally. Detailed information on data protection can be found in our privacy policy below.

Data collection on this website

Who is responsible for data collection on this website?
Data processing on this website is carried out by the website operator. You can find the operator’s contact details in the section “Information on the controller” in this privacy policy.

How do we collect your data?
Some of your data is collected when you provide it to us. This may, for example, be data you enter in a contact form.

Other data is collected automatically or with your consent by our IT systems when you visit the website. This is mainly technical data (e.g. web browser, operating system or time of page access). This data is collected automatically as soon as you enter this website.

What do we use your data for?
Part of the data is collected to ensure that the website is provided without errors. Other data may – with your consent – be used to analyse your user behaviour and for marketing purposes.

What rights do you have regarding your data?
You have the right at any time to receive information free of charge about the origin, recipients and purpose of your stored personal data. You also have the right to request the correction or deletion of this data. If you have given your consent to data processing, you can withdraw this consent at any time with effect for the future. You also have the right, under certain circumstances, to request the restriction of the processing of your personal data. Furthermore, you have the right to lodge a complaint with the competent supervisory authority. You can contact us at any time regarding this and any other questions on the subject of data protection.

Analysis tools and third-party tools

When you visit this website, your browsing behaviour may be statistically analysed. This is done mainly with so-called analysis programs. Detailed information on these analysis programs can be found in the following privacy policy.

2. Hosting

We host the content of our website with the following provider:

loswebos.de GmbH
Maximilianallee 2
04129 Leipzig, Germany
(hereinafter “loswebos”)

When you visit our website, loswebos collects various log files, including your IP addresses. For details, please refer to the loswebos privacy policy: [insert link to loswebos privacy policy].

loswebos is used on the basis of Art. 6(1)(f) GDPR. We have a legitimate interest in presenting our website as reliably as possible. Where corresponding consent has been requested, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and Section 25(1) TDDDG (German Telecommunications Digital Services Data Protection Act), insofar as the consent covers the storage of cookies or access to information on the user’s device (e.g. device fingerprinting) within the meaning of the TDDDG. Consent can be withdrawn at any time.

Data processing agreement

We have concluded a data processing agreement (DPA) for the use of the above-mentioned service. This is a contract required by data protection law which ensures that the provider processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.

3. General Information and Mandatory Information

Data protection

The operators of these pages take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy.

When you use this website, various personal data are collected. This privacy policy explains what data we collect and what we use it for. It also explains how and for what purpose this is done.

Please note that data transmission over the internet (e.g. when communicating by email) may have security gaps. Complete protection of data against access by third parties is not possible.

Information on the controller

The controller responsible for data processing on this website is:

nous UG (haftungsbeschränkt)
Schulstraße 12
85049 Ingolstadt, Germany

Represented by:
Diego Richter (Managing Partner)

Email: post@luminous-agentur.de

The controller is the natural or legal person who, alone or jointly with others, determines the purposes and means of the processing of personal data (e.g. names, email addresses, etc.).

Storage period

Unless a more specific storage period has been stated in this privacy policy, your personal data will remain with us until the purpose for the data processing no longer applies. If you assert a justified request for deletion or withdraw your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing your personal data (e.g. retention periods under tax or commercial law); in the latter case, the data will be deleted once these reasons no longer apply.

General information on the legal basis for data processing on this website

If you have consented to data processing, we process your personal data on the basis of Art. 6(1)(a) GDPR or Art. 9(2)(a) GDPR if special categories of data under Art. 9(1) GDPR are processed. In the case of explicit consent to the transfer of personal data to third countries, data processing is also based on Art. 49(1)(a) GDPR.

If you have consented to the storage of cookies or to access to information on your device (e.g. via device fingerprinting), data processing is additionally based on Section 25(1) TDDDG. Consent can be withdrawn at any time. If your data is required for the performance of a contract or for the implementation of pre-contractual measures, we process your data on the basis of Art. 6(1)(b) GDPR. Furthermore, we process your data if this is necessary to fulfil a legal obligation on the basis of Art. 6(1)(c) GDPR. Data processing may also be carried out on the basis of our legitimate interest under Art. 6(1)(f) GDPR. The relevant legal bases in each individual case are explained in the following paragraphs of this privacy policy.

Data protection officer

Our company is not legally required to appoint a data protection officer and has therefore not appointed one. If you have any questions about data protection, please contact the controller named above directly.

Information on data transfers to the USA and other third countries

Among other things, we use tools from companies based in the USA or other third countries that are not considered safe under data protection law. When these tools are active, your personal data may be transferred to and processed in these third countries. The European Commission has adopted an adequacy decision for the USA (EU-US Data Privacy Framework). Companies certified under this framework are deemed to provide an adequate level of data protection. Information on the individual services can be found in the following sections of this privacy policy.

Recipients of personal data

In the course of our business activities, we work with various external parties. In some cases, this also requires the transfer of personal data to these external parties. We only pass on personal data to external parties if this is necessary for the performance of a contract, if we are legally obliged to do so (e.g. passing on data to tax authorities), if we have a legitimate interest in the disclosure under Art. 6(1)(f) GDPR, or if another legal basis permits the disclosure. When using processors, we only pass on our customers’ personal data on the basis of a valid data processing agreement. In the case of joint processing, a joint processing agreement is concluded.

Withdrawal of your consent to data processing

Many data processing operations are only possible with your explicit consent. You can withdraw consent you have already given at any time. The lawfulness of the data processing carried out until the withdrawal remains unaffected by the withdrawal.

Right to object to data collection in special cases and to direct marketing (Art. 21 GDPR)

IF DATA PROCESSING IS CARRIED OUT ON THE BASIS OF ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT AT ANY TIME TO OBJECT TO THE PROCESSING OF YOUR PERSONAL DATA ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA CONCERNED UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS (OBJECTION UNDER ART. 21(1) GDPR).

IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH MARKETING; THIS ALSO APPLIES TO PROFILING INSOFAR AS IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT MARKETING (OBJECTION UNDER ART. 21(2) GDPR).

Right to lodge a complaint with the competent supervisory authority

In the event of violations of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, their place of work or the place of the alleged violation. The right to lodge a complaint is without prejudice to any other administrative or judicial remedies.

The authority responsible for us is: Bavarian State Office for Data Protection Supervision (Bayerisches Landesamt für Datenschutzaufsicht, BayLDA), Promenade 18, 91522 Ansbach, Germany.

Exercising your rights

To exercise your rights under Art. 15 to 22 GDPR (access, rectification, erasure, restriction of processing, objection, data portability), you can contact us at any time. Please send your request by email to post@luminous-agentur.de or by post to:

nous UG (haftungsbeschränkt)
Schulstraße 12
85049 Ingolstadt, Germany

We will process your request within one month in accordance with the statutory requirements. Should we be unable to respond to your request within this period, you will receive a notification stating the reasons for the delay.

Right to data portability

You have the right to have data that we process automatically on the basis of your consent or in fulfilment of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done to the extent that it is technically feasible.

Access, rectification and erasure

Within the scope of the applicable legal provisions, you have the right at any time to receive information free of charge about your stored personal data, its origin and recipients and the purpose of the data processing and, if applicable, a right to have this data corrected or deleted. You can contact us at any time regarding this and any other questions on the subject of personal data.

Right to restriction of processing

You have the right to request the restriction of the processing of your personal data. You can contact us about this at any time. The right to restriction of processing exists in the following cases:

  • If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. For the duration of the verification, you have the right to request the restriction of the processing of your personal data.
  • If the processing of your personal data was/is unlawful, you can request the restriction of data processing instead of erasure.
  • If we no longer need your personal data, but you need it to exercise, defend or assert legal claims, you have the right to request the restriction of the processing of your personal data instead of its erasure.
  • If you have lodged an objection under Art. 21(1) GDPR, your interests and ours must be weighed against each other. As long as it has not yet been determined whose interests prevail, you have the right to request the restriction of the processing of your personal data.

If you have restricted the processing of your personal data, this data – apart from its storage – may only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or of a Member State.

SSL/TLS encryption

For security reasons and to protect the transmission of confidential content, such as enquiries that you send to us as the site operator, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line.

If SSL or TLS encryption is activated, the data you transmit to us cannot be read by third parties.

Objection to advertising emails

We hereby object to the use of contact data published as part of the imprint obligation for sending unsolicited advertising and information materials. The operators of these pages expressly reserve the right to take legal action in the event of unsolicited advertising information being sent, for example by spam emails.

4. Data Collection on This Website

Cookies

Our website uses so-called “cookies”. Cookies are small data packets and do not cause any damage to your device. They are stored on your device either temporarily for the duration of a session (session cookies) or permanently (persistent cookies). Session cookies are automatically deleted at the end of your visit. Persistent cookies remain stored on your device until you delete them yourself or they are automatically deleted by your web browser.

Cookies can be set by us (first-party cookies) or by third-party companies (so-called third-party cookies). Third-party cookies enable the integration of certain services from third-party companies within websites (e.g. analysis or marketing services).

Cookies have various functions. Many cookies are technically necessary, as certain website functions would not work without them. Other cookies may be used to evaluate user behaviour or for advertising purposes.

On this website, we distinguish between the following categories:

  • Functional (always active): technically necessary cookies, e.g. for storing your cookie settings.
  • Preferences: cookies that store settings and preferences.
  • Statistics: cookies for the anonymous or pseudonymous evaluation of website usage (e.g. Google Analytics).
  • Marketing: cookies for measuring and targeting advertising (e.g. Meta Pixel).

Technically necessary cookies are stored on the basis of Art. 6(1)(f) GDPR and Section 25(2) TDDDG, unless another legal basis is specified. The website operator has a legitimate interest in storing necessary cookies for the technically error-free and optimised provision of its services.

We only use all other cookies and comparable technologies with your consent (Art. 6(1)(a) GDPR in conjunction with Section 25(1) TDDDG). Consent can be withdrawn at any time with effect for the future, e.g. via the cookie settings on this website.

You can also set your browser so that you are informed about the setting of cookies and only allow cookies in individual cases, exclude the acceptance of cookies for certain cases or in general, and activate the automatic deletion of cookies when closing the browser. If cookies are deactivated, the functionality of this website may be limited.

A detailed overview of all cookies used on this website (name, provider, purpose, storage period) can be found in our Cookie Policy (EU).

Consent with Complianz

Our website uses Complianz consent technology to obtain your consent to the storage of certain cookies on your device or to the use of certain technologies and to document this in compliance with data protection law. The provider of this technology is Complianz B.V., Kalmarweg 14-5, 9723 JG Groningen, Netherlands (hereinafter “Complianz”).

Complianz is hosted on our servers, so no connection is established to the servers of the Complianz provider. Complianz stores a cookie in your browser in order to be able to assign the consents you have given or their withdrawal. The data collected in this way is stored until you ask us to delete it, delete the Complianz cookie yourself, or the purpose for storing the data no longer applies. Mandatory statutory retention obligations remain unaffected.

Complianz is used to obtain the legally required consent for the use of cookies. The legal basis for this is Art. 6(1)(c) GDPR.

Server log files

The provider of the pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:

  • browser type and browser version
  • operating system used
  • referrer URL
  • host name of the accessing computer
  • time of the server request
  • IP address

This data is not merged with other data sources.

This data is collected on the basis of Art. 6(1)(f) GDPR. The website operator has a legitimate interest in the technically error-free presentation and optimisation of its website – for this purpose, the server log files must be recorded.

Contact form

If you send us enquiries via the contact form, your details from the enquiry form, including the contact details you provide there, will be stored by us for the purpose of processing the enquiry and in case of follow-up questions. We do not pass on this data without your consent.

This data is processed on the basis of Art. 6(1)(b) GDPR if your enquiry is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of enquiries addressed to us (Art. 6(1)(f) GDPR) or on your consent (Art. 6(1)(a) GDPR) if this has been requested; consent can be withdrawn at any time.

The data you enter in the contact form will remain with us until you ask us to delete it, withdraw your consent to its storage, or the purpose for storing the data no longer applies (e.g. after your enquiry has been processed). Mandatory statutory provisions – in particular retention periods – remain unaffected.

Enquiries by email or telephone

If you contact us by email or telephone, your enquiry, including all resulting personal data (name, enquiry), will be stored and processed by us for the purpose of handling your request.

The data you send to us via contact requests will remain with us until you ask us to delete it, withdraw your consent to its storage, or the purpose for storing the data no longer applies (e.g. after your request has been processed). Mandatory statutory provisions – in particular statutory retention periods – remain unaffected.

5. Analysis Tools and Advertising

Google Tag Manager

We use Google Tag Manager. The provider is Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland.

Google Tag Manager is a tool that allows us to integrate tracking or statistics tools and other technologies into our website. Google Tag Manager itself does not create user profiles, does not store cookies and does not carry out any independent analyses. It is used solely to manage and deliver the tools integrated via it. However, Google Tag Manager does collect your IP address, which may also be transferred to Google’s parent company in the United States.

Google Tag Manager is used on the basis of your consent in accordance with Art. 6(1)(a) GDPR and Section 25(1) TDDDG. Consent can be withdrawn at any time.

The company is certified under the “EU-US Data Privacy Framework” (DPF). The DPF is an agreement between the European Union and the USA intended to ensure compliance with European data protection standards for data processing in the USA. Further information can be obtained from the provider at the following link: https://www.dataprivacyframework.gov/participant/5780.

Google Analytics

This website uses functions of the web analytics service Google Analytics. The provider is Google Ireland Limited (“Google”), Gordon House, Barrow Street, Dublin 4, Ireland.

Google Analytics enables the website operator to analyse the behaviour of website visitors. In doing so, the website operator receives various usage data, such as page views, time spent on the site, operating systems used and the user’s origin. This data is assigned to the respective end device of the user. It is not assigned to a user ID.

Furthermore, Google Analytics allows us, among other things, to record your mouse and scroll movements and clicks. Google Analytics also uses various modelling approaches to supplement the collected data sets and uses machine learning technologies in data analysis.

Google Analytics uses technologies that make it possible to recognise the user for the purpose of analysing user behaviour (e.g. cookies or device fingerprinting). The information collected by Google about the use of this website is usually transferred to a Google server in the USA and stored there.

This service is used on the basis of your consent in accordance with Art. 6(1)(a) GDPR and Section 25(1) TDDDG. Consent can be withdrawn at any time.

Data transfer to the USA is based on the Standard Contractual Clauses of the European Commission. Details can be found here: https://privacy.google.com/businesses/controllerterms/mccs/.

The company is certified under the “EU-US Data Privacy Framework” (DPF). Further information can be found at: https://www.dataprivacyframework.gov/participant/5780.

IP anonymisation

Google Analytics 4 does not store or log complete IP addresses. IP addresses of users from the EU are processed exclusively on servers in the EU and discarded before further processing.

Browser plugin

You can prevent Google from collecting and processing your data by downloading and installing the browser plugin available at the following link: https://tools.google.com/dlpage/gaoptout?hl=en. More information on how Google Analytics handles user data can be found in Google’s privacy policy: https://support.google.com/analytics/answer/6004245?hl=en.

Data processing agreement

We have concluded a data processing agreement with Google and fully implement the strict requirements of the German data protection authorities when using Google Analytics.

Storage period

User-level and event-level data stored by Google that is linked to cookies, user identifiers or advertising IDs is anonymised or deleted after [2 or 14] months. Details can be found at: https://support.google.com/analytics/answer/7667196?hl=en.

Meta Pixel (formerly Facebook Pixel)

This website uses Meta’s visitor action pixel for conversion measurement. The provider of this service is Meta Platforms Ireland Limited, 4 Grand Canal Square, Dublin 2, Ireland. According to Meta, however, the collected data is also transferred to the USA and other third countries.

This allows the behaviour of page visitors to be tracked after they have been redirected to the provider’s website by clicking on a Meta advertisement. This enables the effectiveness of Meta advertisements to be evaluated for statistical and market research purposes and future advertising measures to be optimised.

The data collected is anonymous for us as the operator of this website; we cannot draw any conclusions about the identity of the users. However, the data is stored and processed by Meta, so that a connection to the respective user profile is possible and Meta can use the data for its own advertising purposes in accordance with the Meta Data Policy. This enables Meta to display advertisements on Meta pages as well as outside of Meta. This use of the data cannot be influenced by us as the site operator.

This service is used on the basis of your consent in accordance with Art. 6(1)(a) GDPR and Section 25(1) TDDDG. Consent can be withdrawn at any time.

Insofar as personal data is collected on our website with the help of the tool described here and forwarded to Meta, we and Meta Platforms Ireland Limited are jointly responsible for this data processing (Art. 26 GDPR). Joint responsibility is limited exclusively to the collection of the data and its transfer to Meta. The processing carried out by Meta after the transfer is not part of the joint responsibility. The obligations incumbent on us jointly have been set out in a joint processing agreement. The wording of the agreement can be found at: https://www.facebook.com/legal/controller_addendum. According to this agreement, we are responsible for providing the data protection information when using the Meta tool and for the data protection-compliant implementation of the tool on our website. Meta is responsible for the data security of Meta products. You can assert data subject rights (e.g. requests for information) regarding the data processed by Meta directly with Meta. If you assert your data subject rights with us, we are obliged to forward them to Meta.

Data transfer to the USA is based on the Standard Contractual Clauses of the European Commission. Details can be found here: https://www.facebook.com/legal/EU_data_transfer_addendum and https://www.facebook.com/help/566994660333381.

Further information on protecting your privacy can be found in Meta’s privacy notice: https://www.facebook.com/about/privacy/. You can also deactivate the “Custom Audiences” remarketing function in the ad settings section at https://www.facebook.com/adpreferences/ad_settings/. To do this, you must be logged in to Facebook. If you do not have a Facebook account, you can deactivate usage-based advertising from Facebook on the website of the European Interactive Digital Advertising Alliance: http://www.youronlinechoices.com/.

The company is certified under the “EU-US Data Privacy Framework” (DPF). Further information can be found at: https://www.dataprivacyframework.gov/participant/4452.

6. Ticket Sales

External ticket shop

Tickets are not sold via this website, but via the external ticket provider [name and address of ticket provider]. When you click on a corresponding link or button, you will be redirected to the ticket provider’s website.

The data you provide when purchasing tickets (e.g. name, email address, billing and payment details) is processed by the ticket provider to complete the purchase. The legal basis is Art. 6(1)(b) GDPR (performance of a contract). Insofar as we, as the organiser, receive data about your booking from the ticket provider (e.g. for admission control or to inform you of changes to the event), this is also done on the basis of Art. 6(1)(b) GDPR or our legitimate interest under Art. 6(1)(f) GDPR.

For details on how your data is handled, please refer to the ticket provider’s privacy policy.

7. Our Social Media Presence

Data processing by social networks

We maintain publicly accessible profiles on social networks. The individual social networks we use are listed below.

Social networks such as Facebook or Instagram can generally analyse your user behaviour comprehensively when you visit their website or a website with integrated social media content (e.g. like buttons or advertising banners). Visiting our social media presences triggers numerous processing operations relevant to data protection.

In detail

If you are logged in to your social media account and visit our social media presence, the operator of the social media portal can assign this visit to your user account. However, your personal data may under certain circumstances also be collected if you are not logged in or do not have an account with the respective social media portal. In this case, data is collected, for example, via cookies stored on your device or by recording your IP address.

With the help of the data collected in this way, the operators of the social media portals can create user profiles in which your preferences and interests are stored. In this way, interest-based advertising can be displayed to you inside and outside the respective social media presence. If you have an account with the respective social network, interest-based advertising can be displayed on all devices on which you are or were logged in.

Please also note that we cannot track all processing operations on the social media portals. Depending on the provider, further processing operations may therefore be carried out by the operators of the social media portals. For details, please refer to the terms of use and privacy policies of the respective social media portals.

Legal basis

Our social media presences are intended to ensure the widest possible presence on the internet. This is a legitimate interest within the meaning of Art. 6(1)(f) GDPR. The analysis processes initiated by the social networks may be based on different legal bases, which must be specified by the operators of the social networks (e.g. consent within the meaning of Art. 6(1)(a) GDPR).

Controller and assertion of rights

If you visit one of our social media presences (e.g. Facebook), we are jointly responsible with the operator of the social media platform under Art. 26 GDPR for the data processing operations triggered during this visit. You can generally assert your rights (access, rectification, erasure, restriction of processing, data portability and complaint) both against us and against the operator of the respective social media portal (e.g. against Meta). The basis for this is the joint controllership agreement (Meta’s “Page Controller Addendum”).

Please note that, despite the joint responsibility with the social media portal operators, we do not have full influence on the data processing operations of the social media portals. Our options depend largely on the corporate policy of the respective provider.

Storage period

The data collected directly by us via the social media presence will be deleted from our systems as soon as you ask us to delete it, withdraw your consent to its storage, or the purpose for storing the data no longer applies. Stored cookies remain on your device until you delete them. Mandatory statutory provisions – in particular retention periods – remain unaffected.

We have no influence on the storage period of your data that is stored by the operators of the social networks for their own purposes. For details, please contact the operators of the social networks directly (e.g. in their privacy policy, see below).

Social networks in detail

Facebook

We have a profile on Facebook. The provider of this service is Meta Platforms Ireland Limited, 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland. According to Meta, the collected data is also transferred to the USA and other third countries.

We have concluded a joint processing agreement (Controller Addendum) with Meta. This agreement specifies which data processing operations we or Meta are responsible for when you visit our Facebook page. You can view this agreement at the following link: https://www.facebook.com/legal/terms/page_controller_addendum.

You can adjust your advertising settings yourself in your user account: https://www.facebook.com/adpreferences/ad_settings/.

Data transfer to the USA is based on the Standard Contractual Clauses of the European Commission. Details can be found here: https://www.facebook.com/legal/EU_data_transfer_addendum and https://www.facebook.com/help/566994660333381.

For details, please refer to Facebook’s privacy policy: https://www.facebook.com/about/privacy/.
